A1 Martín Ramos, Adrián A2 Grado En Derecho K1 Autodeterminación K1 Colonización K1 Sáhara Occidental K1 Plan de Arreglo K1 Plan Baker K1 Resolución AB This paper examines the Western Sahara conflict by exposing and analysingthe United Nations resolutions that grant the Sahrawi people their right toself-determination and to constitute themselves as an independent state.Firstly, a brief historical context is provided, showing Spain's colonisation ofthe entire territory. It also discusses the agreements between Spain andMorocco on the region.Next, the concept of terra nullius is discussed, which does not allow Spain toacquire sovereignty over the territory through occupation, since an organisedpeople already existed beforehand, whose right to self-determination will berecognised by the United Nations. Furthermore, the constitution andlegitimacy of the Sahrawi Arab Republic will be analysed.Having seen the rights of the Saharawi people, the positions of both theUnited Nations and the African Union will be presented, as well as theinability to find a solution to this conflict due to Morocco's persistence innot complying with the Settlement Plan or the Baker Plan.Finally, Morocco, due to its refusal to comply with international law, willmake an Autonomy Proposal in 2007, which greatly benefits its claims tothe area at the expense of the right of all Saharawis to live freely. Inconclusion, the responsibilities that Spain still has in the region as anadministering power will be mentioned.
