AB Sham marriages, simulated marriages, marriages under false pretences,marriages under fraudulent pretence, are a growing phenomenon in oursocieties. They are caused by the will of people from impoverished countrieswho, seeking to establish themselves in the common European area, contractthe fraudulent link to obtain the privileges, benefits and/or rights that thelegal system grants to the spouses of nationals (residence, familyreunification, nationality, etc.).The marriage bond is vitiated by simulation, false pretence or fraudulentpretence, the ultimate result of which is the declaration of nullity and the lossof the alleged benefits.
