AB The Draft Law on Procedural Efficiency Measures implements a series ofmeasures to reduce delays and costs in the Administration of Justice. One ofthese will be to promote the use of alternative means to jurisdiction for theresolution of legal disputes.To this end, in certain civil and commercial matters, the parties will have toattempt prior negotiation through one of these "appropriate" means to try toreach an agreement that benefits both parties and avoids a long and costlyprocess.The options offered by the pre-legislator range from direct negotiation,mediation and conciliation to newly-created figures such as the confidentialbinding offer and the opinion of an independent expert.For now, only time will tell whether this measure has achieved its objective or,on the contrary, has simply meant a new bureaucratic step on the road to accessto justice and process.
