RT info:eu-repo/semantics/bachelorThesis T1 La vulneración de derechos fundamentales y la normativa covid 2020 - 2021 A1 Estévez Riudavets, Alberto A2 Grado En Derecho K1 Derechos fundamentales K1 Estado de alarma K1 Normativa COVID-19 K1 Limitación K1 Suspensión y Vacunación AB The Spanish Constitution of 1978 as a norm of superior rank of our legal system,dedicates its articles fourteen to twenty-nine to fundamental rights, characterized bycontaining a broad legal regime of protection but some of them susceptible to beingable to be suspended when the declaration of the state is agreed exception or site.And the health emergency caused by COVID-19 or SARS-CoV-2 required newregulations from the Executive Power to alleviate the health effects of this pandemic,but in turn generated a direct conflict with those fundamental rights due to thedeclaration of the state alarm carried out by the Government on 14 March 2020, a statewith little historical application in Spain given its exceptional nature and due to therequirements and limitations that it entails in order to ensure the restoration ofnormality.Conflicts jurisdiction of the Constitutional Court that entailed the study of two classiclegal figures, the distinction between the limitation and suspension of fundamentalrights, a matter of great relevance due to the restrictive nature of the state of alarm.Finally forming the essential study contents of this work, based on the compilation ofthe actions of the three powers of the state during the situation of special historical andlegal significance of COVID-19 to deal in a related way with the possibility ofintroducing mandatory vaccination in our legal system within the Spanish constitutionalframework.
