AB The teaching of Religion in the Spanish Education System has been, and remains, an extremelycontroversial topic that involves family, state and religion since the establishment of the firsteducational laws. The Spanish Constitution, the Religious Freedom Organic Act, and theagreements on Religion and education matters between the Holy See, the Spanish state andother religious creeds constitute a legislative framework designed to ensure the right of freedomof religious beliefs and the presence of religious courses in our country. Thus, this documentaims at providing a theoretical revision of the historical development of the subject of religionin the Spanish Education System. First, the historical, political and social records will bepresented. Secondly, data regarding the laws implicated in the process will be collected andanalyzed. In this case, the categories of analysis will be: the philosophical aspects of eachreligious subject; and the educational structure.
