The legal conditions and legal conflicts that arise around thissituation are examined. It is argued that it is essential to guarantee that thechild conceived post-mortem has access to hereditary rights on equal termswith children conceived naturally, in line with the constitutional principlesof equality and comprehensive protection of children.It is proposed to adapt current legislation so that possible discrimination iseliminated, and equitable treatment is ensured for all children of thedeceased, regardless of the circumstances of their conception. It isnecessary to address fundamental issues related to the determination ofparentage and representation of the conceived post-mortem, ensuring thattheir rights are fully recognized and that their status as a descendant of thedeceased is respected.A comprehensive legal review is advocated to guarantee equity in theinheritance rights of those conceived post-mortem. It is crucial thatlegislation adequately reflects advances in reproductive medicine andscience, as well as fundamental principles of justice and the protection ofindividual rights. Only in this way can it be ensured that all children,regardless of the circumstances of their conception, receive fair andequitable treatment about their inheritance and succession rights.
