AB The bankruptcy qualification is one of the sections of the bankruptcyprocess. This qualification piece is carried out to analyze the causes of thedebtor's state of insolvency and check whether he has acted maliciously togenerate or aggravate the insolvency (guilty bankruptcy) or if, on thecontrary, it has been generated by causes beyond his conduct (fortuitousbankruptcy).If the bankruptcy is classified as guilty, the judge may condemn all or someof the administrators, liquidators, de jure or de facto, or general directors ofthe bankrupt legal entity who have been declared persons affected by thebankruptcy, to cover the deficit. the qualification to the extent that theconduct of these people that determined the classification of the bankruptcyas guilty would have generated or aggravated the insolvency.This Final Degree Project focuses on the evolution that this qualification hasobtained doctrinally and jurisprudentially and on the disconnection thatexists with the cr
