AB The article 368 CP punishes a series of behaviours related to drugproduction and trafficking. There are doctrinal and jurisprudentialdiscussions regarding the legal interest protected, what is considered drugand the non-criminal behaviours.The Public Health is the protected legal interest and is understood as alevel of general well-being. Moreover, toxic drugs, narcotics andpsychotropics substances are the material object of the crime and are setaccording to the International Conventions signed by Spain.Article 368 Cp covers a wide range of behaviours, which has led to thejurisprudential creation of a series of scenarios considered atypical, noncriminal. These include self-consumption, shared consumption,compassionate donations and the sale of insignificant quantities. Theseexceptions are justified by its insignificance, the lack of harm to PublicHealth and the absence of the intention to traffic.
