AB This paper presents the fundamental right to the inviolability of the home (art. 18.2) of theSpanish Constitution of 1978 about the entry and search of legal persons with a preciseapproach to labour inspection. These fundamental right influences, in a precise and direct way,the people's personal sphere that every Constitution of a democratic country must protect.The purpose of this work focuses on analysing the violation of this fundamental rightconcerning the entry and search of legal persons, addressing the aspects of the visit ofworkplaces, in this case from the home as a place of work. As well as open workplaces, suchas factories, workshops, and warehouses, since labour inspectors play a role in enforcingcompliance with labour regulations.At the same time in this work, we will analyse telework, as it affects working from home in atelematic way, concerning the inspection activity and the applicable regulation for the safetyand health at work.
