AB In this society it exists many ways of discrimination that violate thefundamental right of equality that people have. One of the most worryingways of discrimination is the discrimination based on racial and ethnicsreasons.Therefore, the need arises to regulate a European regulation, in this case, adirective that establishes minimums that countries of European Union mustachieve. This is when the 2000/43 EC of 29th of June of 2000 directiverelative to the application of the principle of equal treatment. The principleof equal treatment is, according to the directive, any absence of direct orindirect discrimination based on racial or ethnic origin.A directive is a Union European’s legislative act that it has certaincharacteristics that distinguish it from other types of legislative acts likeregulations or opinions. It establishes some obligatory goals regarding theresults, and it allow to the member states of European Union the freedom interms of means and forms to achieve these goals.This directive offers some mandates to be fulfilled by member states thatare recipients of the directive itself, definitions about the different conceptson the matter of the directive like direct and indirect discrimination orharassment, it grants the power of exercise positive action measures aimedat defending to victims of discrimination of insecurity situations, itestablishes a sanctioning regime and a deadline to transpose the minimumsestablished in the directive in the national laws of member states and thesubsequent report to the Commission.Besides, it will ensure that member states have different administrations incharge of ensuring the protection of equal treatment and make differentstudies and investigations about the matter for later develop someconclusions about the effectiveness of the regulations.
