AB The aim of this research work focuses on undue provisional prison as one of the threecases in which state’s liability for the abnormal functioning of the Administration ofJustice is generated (Article 121 of the Spanish Constitution in relation to Articles 292-296 of the Organic Law of the Judiciary). It first analyzes the liability of PublicAdministrations in a broad sense (Article 106 of the Spanish Constitution) and thennarrows down to the liability of the Administration of Justice, for this a brief overviewof the three cases that generate liability, with special emphasis on undue provisionalprison, as well as the doctrinal and jurisprudential issues it raises and the criteria used toobtain the compensation provided for in Article 294 of the LOPJ.
