AB Before Law 15/2005, of 8 July, through which the joint custody regime wasintroduced in our Civil Code, this established that the general rule was theadoption of sole custody in favor of one of the two parents. However, aftersaid Law, shared custody is considered another model of custody, which hasgenerated certain debates that the Supreme Court has been in charge ofresolving by establishing that said regime is normal and even desirable aslong as it protects the best interests of the minor.In this work we will mention the different types of guard and custody thatexist, but we will especially study shared custody, analyzing the differentmodels of this; its legal and jurisprudential evolution; the principles on whichsaid regime is based; the criteria established by the Supreme Court that willbe taken into account for its adoption and, finally, the causes for denial ofshared custody.
