AB Since its inception, the European Union has sought to create, maintain and promotecommon objectives as an international organization. One of its primary objectives isto protect and promote the fundamental values of Article 2 TEU, which are: respectfor human dignity, freedom, democracy, equality, the rule of law and respect forhuman rights, including the rights of persons belonging to minorities. In order toprotect these values, the TEU grants the Union a sanctioning mechanism in Article 7,which was activated for Poland and Hungary years ago, but which has proved topossess insufficiencies for the current reality in the EU. The purpose of this paper isto study the mechanism for the protection of the fundamental values of the EU, fromits evolution as a norm to the analysis of its limitations, taking as an example itscurrent materialization in the cases of Poland and Hungary.
