El contrato de permuta, olvidado en el tráfico jurídico, ha vivido en los últimos años un
importante auge en el ámbito inmobiliario hasta convertirse en un instrumento básico y de
incuestionable actualidad en la construcción inmobiliaria. En este artículo se analizan las
controversias que esta modalidad contractual presenta en la práctica y se apuntan soluciones
y propuesta de lege ferenda de cara a una futura reforma normativa.
The almost forgotten barter contract has experienced an importan
revival in the real estate industry in the last few years to the extent of becoming a basic
legal instrument in the construction business. This paper analyses some of the difficulties
that this type of contracts may encounter and suggests lege ferenda solutions for future
legal reforms.
