La herencia digital

Abstract

El presente trabajo aborda el amplio campo del testamento digital, un tema de actualidad y del cual hay un inmenso campo aún por descubrir, y que, con la importante incorporación de las nuevas tecnologías nos ayudan a comprender de una manera más clarividente el tema a desarrollar. Durante este trabajo podremos conocer qué es realmente el testamento digital, si existe o no el testamento online, la importantísima función de los notarios, el derecho y la identidad digital post- mortem, cómo se realiza la transmisión de archivos digitales, así como la identidad virtual y digital. Trataré de explicar que ocurre con todos aquellos archivos, cuentas, perfiles y demás identidades que posee el causante y de qué manera se van a gestionar. Por último, abordaré en concreto la herencia en Bitcoin, es decir, todo lo relacionado con las criptomonedas en caso de que el causante tuviera una herencia con este tipo de moneda virtual.

The present work deals with the wide field of digital testament, a current issue and of which there is an immense field yet to be discovered, and that, with the important incorporation of new technologies help us to understand in a more clairvoyant way the subject to develop. During this work we will be able to know what the digital testament really is, if the online testament exists, the important role of notaries, the right and the digital identity post-mortem, how digital files are transmitted, as well as the virtual and digital identity. I will try to explain what happens with all those files, accounts, profiles and other identities that the deceased has and in which way they will be managed. Finally, I will specifically address the inheritance in Bitcoin, that is, everything related to cryptocurrencies in case the causer had an inheritance with this type of virtual currency.
