El interés superior del menor en el proceso de acogimiento

The so-called higher interest of the child is presented as an indeterminate legal
concept whose lack of determination makes it the legislator who, under a
discretionary judgment, makes the decisions. As far as the placement is
concerned, the best interests of the minor are exhibited as the basis by which the
minor must be produced, it must be ensured that when a minor is declared in
distress and placed in the hands of the public administration, the motivation by
which decisions must be made must always be the achievement of the best
interests of the child. In spite of this, we must not forget that sometimes it is
difficult to pretend to legislate when there are no specific premises that define
what is intended to be defended. This is the difficult task that the legislator has
especially in the issue that is going to be treated,because there are as many cases
as decisions can be made and it is a fundamental task that there is a symmetry
between the resolution that is adopted and what really child needs. El denominado interés superior del menor se presenta como un concepto jurídico
indeterminado cuya falta de determinación hace que sea el juez el que bajo un
juicio propio con carácter discrecional, tome las decisiones. En lo que al
acogimiento se refiere el interés superior del menor se exhibe como la base
mediante la cual el mismo debe producirse, se debe procurar que cuando un
menor es declarado en desamparo y puesto en manos de la Administración
Pública, la motivación mediante la que se deben tomar decisiones deberá ser
siempre la consecución del interés superior del menor. A pesar de ello, no hay que
obviar que en ocasiones resulta complicado pretender legislar cuando no hay unas
premisas concretas que definan y delimiten lo que se pretende defender. Esta es la
difícil labor que tiene el juez sobre todo en el tema que se va a tratar que es el
acogimiento, pues existen tantos casos como decisiones pueden tomarse y es
tarea fundamental que haya una simetría entre la resolución que se adopta y lo
que realmente necesita el menor.
