Responsabilidad patrimonial de la administración sanitaria: requisitos y alcance

Abstract

En este trabajo, trataremos la responsabilidad de la Administración, pero específicamente en el sector sanitario. Como primer elemento esclarecedor haremos una breve evolución histórica de la responsabilidad, comenzaremos con los precedentes históricos con carácter general y tendremos especial consideración en España. Asimismo, explicaremos los requisitos y elementos necesarios para que crezca el derecho a ser indemnizado. El objeto de este trabajo tendrá como estructura; por un lado, los requisitos objetivos, los subjetivos, así como, los títulos de imputación necesarios para que exista responsabilidad, y aquellas causas que la excluyen. Por último, tras explicar los elementos necesarios para que se impute responsabilidad a la Administración, haremos una breve conclusión con aquellos aspectos que hemos aprendido y así como nuestra opinión acerca de este tema

In this work, we will deal with the responsibility of the Administration, but specifically in the healthcare sector. As an enlightening first element we will make a brief historical evolution of responsibility, we will begin with historical precedents in general and have special consideration in Spain. Likewise, we will also explain the requirements and elements necessary for the right to be compensated to grow.The object of this work will be structured; on the one hand, objective requirements, subjective requirements,just as,the imputation securities necessary for liability, and those grounds that exclude it. Finally, after explaining the elements necessary for liability to the Administration, we will conclude briefly with those aspects we have learned and as well as our opinion on this topic.
