El derecho de libertad religiosa y de conciencia del menor en el contexto familiar

Abstract

In this project we will analyze the content and scope of the child's right to religious and conscience freedom taking particular account of the influence of the exercise of parental authority in relation to those rights. To this end, we will rely on the numerous doctrinal and jurisprudential contributions as well as the diverse legislative output on the subject at hand. Therefore, we will start from the constitutional recognition of the right of religious and conscience freedom in a general way and we will go into post-constitutional legislation both nationally and internationally. Having considered the laws recognizing the rights of minors as well as those of parents or guardians in respect of them, we will be able to know, through different judgments, real cases in which there has been an interference of the parental authority on the child's right to religious and conscience freedom. Subsequently, and before presenting the conclusions, we will deal with a current topic of particular relevance and that is intimately linked to the content of this work: the "parental pin".

En el presente trabajo analizaremos el contenido y alcance del derecho de libertad religiosa y de conciencia del menor teniendo en especial consideración la influencia del ejercicio de la patria potestad en relación con aquél. Para ello, nos apoyaremos en las numerosas aportaciones doctrinales y jurisprudenciales así como en la diversa producción legislativa relativa al tema que nos ocupa. Por lo tanto, partiremos del reconocimiento constitucional del derecho de libertad religiosa y de conciencia de modo general y nos iremos adentrando en legislación post-constitucional tanto a nivel nacional como internacional. Una vez analizadas las leyes en las que se reconocen los derechos de los menores así como los de los progenitores o tutores respecto a ellos, vamos a poder conocer, a través de distintas sentencias, casos reales en los que se ha producido una injerencia de la patria potestad en el derecho de libertad religiosa y de conciencia del menor. Posteriormente y antes de finalizar con las conclusiones, incidiremos en un tema actual de especial relevancia y que está íntimamente ligado con el contenido de este trabajo: el pin parental.
