Análisis del régimen de la guarda y custodia compartida de los hijos menores

Abstract

This work is based on the analysis of the legal guardianship or child custody, with a small reference to its regulation in the past, before the present text of the Civil Code was applied. The way courts have ruled, and some significant judicial decisions are also analyzed, as well as the most common problems that appear on a daily basis. At the same time, the principles that rule child custody will be studied, including quotes of court rulings of the Supreme Court and the Constitutional Court related to child guardianship in general and joint custody in particular and also, doctrinal positions and considerations of joint custody with the aim of finding the most beneficial model for the children interest. Specifically, the main issues faced by our courts at the time of attributing the use of the family home or alimony will be exposed. Finally, an examination of the situation of COVID-19 and the agreements taken by the different Family Courts with regard to what was arranged by the General Council of the Judiciary will take place.

El presente trabajo intentará realizar un análisis de la figura de la guarda y custodia compartida, haciendo una breve referencia a su aplicación con anterioridad a nuestra actual normativa recogida en el Código Civil. También se expondrán las doctrinas jurisprudenciales elaboradas en torno a la figura y los problemas prácticos que se plantean en el día a día. En particular se estudiarán los principios que rigen la atribución de la guarda y custodia de los menores, con citas de las sentencias del Tribunal Supremo y del Tribunal Constitucional, en relación con la guarda de menores en general y la custodia compartida en especial, así como las posiciones doctrinales en relación con el modelo más beneficioso para el interés del menor. Concretamente se plasmarán aquellas cuestiones más problemáticas que se encuentran nuestros tribunales en el momento de atribuir el uso de la vivienda familiar o la pensión alimenticia. Por último, se reflejará la situación del Covid-19 y los acuerdos tomados por los diferentes Juzgados de Familia respecto a lo acordado por el Consejo General del Poder Judicial.
