El acoso laboral: ¿una verdadera protección de los trabajadores por el Derecho Penal?

Abstract

Tras un intenso debate, la reforma efectuada por la Ley Orgánica 5/2010, introduce en nuestro ordenamiento jurídico el delito de acoso laboral en el art. 173.1, párrafo segundo, del CP, también conocido como mobbing, dando al fin protección penal a este tipo de conductas que humillan o cosifican al trabajador en su ámbito de trabajo. En el presente trabajo de investigación se pretende abordar la delimitación conceptual de este tipo delictivo, efectuar un análisis jurídico de sus elementos y dilucidar si incumple las exigencias del principio de taxatividad y, en definitiva, determinar si este precepto cumple con los principios y función del Derecho penal y plantear propuestas de lege ferenda en aquellos aspectos que deban ser objeto de revisión por parte del legislador.

After intense debate, the reform carried out by Organic Law 5/2010, introduces in our legal system the crime of workplace harassment in art. 173.1, second paragraph, of the CP, also known as mobbing, finally giving criminal protection to this type of conduct that humiliates or objectifies the worker in his workplace. This research work aims to address the conceptual delimitation of this criminal type, carry out a legal analysis of its elements and elucidate if it fails to comply with the requirements of the taxation principle and, ultimately, determine if this precept complies with the principles and function of the Criminal law and propose lege ferenda proposals in those aspects that should be reviewed by the legislator.
