Atribución del uso de la vivienda familiar tras las crisis matrimoniales existiendo hijos menores de edad

Abstract

Tras la crisis matrimonial una de las cuestiones que mas se plantean en la práctica es la atribución del uso de la vivienda familiar. En el tema que nos compete nos hemos centrado en los supuestos en los que existen hijos menores de edad. En estos casos, la atribución del uso de la vivienda familiar podrá acordarse de mutuo acuerdo por los progenitores, o mediante resolución judicial, siempre garantizando el interés superior del menor, ya que en el caso de existir hijos menores de edad será el punto de partida para atribuir el uso de la vivienda familiar con independencia de la titularidad de la misma.

After the marriage crisis, one of the questions that arises most in practice is the attribution of the use of family housing. In this area, we have focused on cases where there are underage children. In these cases, the attribution of the use of the family home may be settled by mutual agreement between the parents, or by court order, always guaranteeing the best interests of the minor, since in the case of the existence of minor children it will be the starting point for the attribution of the use of the family home regardless of its ownership.
