Sistema de patentes, licencias obligatorias y vacuna del COVID-19: posibles soluciones

Abstract

El COVID-19 es un virus que ha empezado a expandirse a nivel mundial desde finales del 2019. Los científicos de distintos países se han centrado en la creación de una vacuna que le ponga fin. Pero una vez inventadas las vacunas viene el problema de su fabricación y su distribución. El siguiente trabajo tiene como objetivo estudiar la viabilidad de otorgar licencias obligatorias para la fabricación de la vacuna del COVID19, ya que supone una forma de acceder a ellas en la que se beneficia tanto el titular de la patente como los consumidores. Esto se realizará mediante el estudio de las licencias obligatorias y también mediante el estudio de otros mecanismos jurídicos alternativos, como son la expropiación forzosa de la patente o la suspensión de las patentes, con las que se podría para conseguir el objetivo de que la vacuna del COVID-19 pudiera llegar a todos los habitantes de planeta.

COVID-19 is a virus that has begun to spread globally since the end of 2019. Scientists in different countries have focused on creating a vaccine to end it. But once vaccines are invented comes the problem of their manufacture and distribution. The following work aims to study the feasibility of granting compulsory licenses for the manufacture of the COVID-19 vaccine, since it is a way of accessing them in which both the patent holder and the consumers benefit. This will be done through the study of compulsory licenses and also through the study of other alternative legal mechanisms, such as the compulsory expropriation of the patent or the suspension of patents, with which it could be possible to achieve the objective that the vaccine of the COVID-19 could reach all the inhabitants of the planet.
