Abstract

La cirugía estética es una disciplina de gran antigüedad que ha prosperado y sigue generando cuestiones, intereses y opiniones hasta el actual siglo XXI. La necesidad de preservar la belleza de la juventud durante amplios períodos de tiempo, las disconformidades humanas con la aceptación de su cuerpo y los nuevos avances tecnológicos en materia sanitaria han contribuido al desarrollo de la cirugía estética como especialidad profesional dentro del estudio de la sanidad. Ello ha dado lugar a las continuas demandas que afloran constantemente por parte de los pacientes hacia los galenos y los propios hospitales, debido a la voluntariedad de la práctica y la controvertida y evolutiva responsabilidad civil de estos profesionales. El carácter voluntario de la intervención y la prestación económica que perciben los sanitarios por su realización, excediéndose de la salud pública en muchas ocasiones y sumergiéndose en la sanidad privada, ha conllevado no solo una diligente exigencia de la buena praxis del galeno sino a una mayor responsabilidad del mismo, pudiendo incurrir con mayores facilidades en negligencias médicas al no cumplir con ciertos deberes jurisprudencialmente estipulados, como puede ser informar al paciente de los riesgos de la operación. El presente trabajo pretende realizar un análisis de los diferentes planteamientos jurisprudenciales que se han dado a lo largo de los años y han derivado en la teoría de la obligación de medios acogida en la actualidad, analizando cuestiones matizables, atendiendo a la Medicina satisfactiva y valorando posibles soluciones no judiciales a estos conflictos.

Cosmetic surgery is a discipline of great antiquity that has flourished and continues to generate questions, interests and opinions until the current 21st century. The need to preserve the beauty of youth for long periods of time, human disagreements with the acceptance of the body and new technological advances in health have contributed to the development of cosmetic surgery as a professional specialty within the study of health. This has given rise to the continuous demands that patients constantly surface towards physicians and the hospitals themselves, due to the voluntary nature of the practice and the controversial and evolving civil liability of these professionals. The voluntary nature of the intervention and the financial benefit received by health workers for its performance, exceeding public health on many occasions and immersing themselves in private health, has led not only to a diligent demand for good practice from the doctor but to a greater responsibility of the same, being able to incur with greater facilities in medical negligence by not complying with certain jurisprudentially stipulated duties, such as informing the patient of the risks of the operation. The present work aims to carry out an analysis of the different jurisprudential approaches that have been given over the years and have derived in the theory of the obligation of means accepted at present, analyzing nuanced questions taking into account satisfactory Medicine and evaluating possible solutions not judicial to these conflicts.
