El Ministerio Fiscal como órgano instructor en el Anteproyecto de la Ley de Enjuiciamiento Criminal 2020

Abstract

En el presente trabajo de investigación se analiza el papel del Ministerio Fiscal, en el Anteproyecto de Ley de Enjuiciamiento Criminal de 2020, cuya novedad principal es la asunción de la dirección de la instrucción del Ministerio Fiscal. Para analizarlo, se tendrá en cuenta el papel que ya asume el Ministerio Fiscal como instructor en el procedimiento de responsabilidad penal del menor así como las distintas propuestas de reforma de la Ley de Enjuiciamiento Criminal; la del año 2011 y la del año 2013. A partir de todo ello, se profundizará en los fundamentos de este nuevo Anteproyecto de 2020 y se desarrollará las distintas consecuencias de esta nueva regulación de la dirección de la instrucción.

In this work, the role of the Spanish Public Prosecutor's Office is analyzed, after the reform of the new Draft Law on Criminal Procedure of 2020, which main novelty is the assumption of the direction of the instruction by the Public Prosecutor's Office. To analyze it, the role that the Public Prosecutor already assumes as an instructor in the criminal responsibility procedure of the minor, will be taken into account, as well as the different proposals for the reform of the Criminal Procedure Law, such as that of 2011 and 2013. Based on all this, the foundations of this new Draft Project will be studied in depth and the different consequences of this new regulation of the direction of instruction will be developed.
