El deber de imparcialidad de jueces y magistrados

La imparcialidad judicial constituye una de las garantías más esenciales de la
función jurisdiccional, entendiendo en muchas ocasiones que debe existir dicha
garantía para encontrarnos ante un proceso justo y que cumple con los principios
que se recogen, en la normativa internacional, europea y en nuestro Ordenamiento
Jurídico.
Por tanto, el juez tiene que ser un tercero ajeno al conflicto, en lo que a las
partes y al objeto del proceso se refiere, sin poder conocer tampoco del caso
concreto en las fases anteriores al juicio, delimitando el conocimiento de la fase de
instrucción y la de enjuiciamiento a jueces diferentes, para así salvaguardar tal
garantía.
A su vez, como garantía de tal derecho-deber, existen los mecanismos de
Abstención y Recusación, ya que cuando se hace referencia a la imparcialidad
judicial, se hace desde un punto de vista constitucional, debido a que el objetivo de
la función judicial es vigilar e intervenir en el desarrollo del proceso en base a las
garantías constitucionales correspondientes al debido proceso y la seguridad
jurídica. The judicial impartiality constitutes one of the most essential guarantees of the
jurisdictional function, understanding with many occasions that the above
mentioned guarantee must exist to be before a just process and that expires with
the beginning that are gathered, in the international, European regulation and in
our legal system.
Therefore, the judge has to be a third party foreign to the conflict, in what to
the parts and in order to the process it refers, without not also being able to know
about the concrete case in the phases previous to the judgment, delimiting the
knowledge of the phase of instruction and that of prosecution to different judges,
this way to safeguard such a guarantee.
In turn, like guarantee of such a right - duty, there exist the mechanisms of
Abstention and Objection, since when one refers to the judicial impartiality, it is
done from a constitutional point of view, due to the fact that the aim of the judicial
function is to monitor and to intervene in the development of the process on the
basis of the constitutional rights corresponding to the due process and the juridical
safety.
