The aim of this work is to define the responses offered by urban planning law to adapt the General
Plan to the emergence of new social, environmental, territorial, urban or economic needs.
It will be carried out through the comparison of both consolidated texts, the Law of 1976 and the
new Law 4/2017 of the Soil and Protected Natural Areas of the Canary Islands, which approves the
Regulation of the planning used for the Canary Islands.
The General Plan is the central object of the work, for this reason, its definition and characteristics
will be mentioned. Several points relating to the meaning of the necessities that have arisen, and
which are urgent and the answers to these problems will be discussed below.
This analysis is determined by excessive rigor and its legislative treatment to relax its
determinations to adjust it to reality. Este trabajo tiene como objetivo delimitar las respuestas que se ofrecen desde el derecho
urbanístico para la adaptación del Plan General de Ordenación al surgimiento de nuevas
necesidades sociales, ambientales, territoriales, urbanísticas o económicas de cada momento.
Se realizará a través de la puesta en comparación tanto del Texto Refundido de la Ley del Suelo
de 1976 como la nueva Ley 4/2017 del Suelo y los Espacios Naturales Protegidos de Canarias por
el que se aprueba el Reglamento de Planeamiento de Canarias.
El Plan General de Ordenación constituye el objeto central del trabajo, por este motivo, se incidirá
en su definición y características. A continuación, se tratarán diversos puntos relacionados con el
significado de las necesidades sobrevenidas y perentorias además de las respuestas que ofrecen
tanto la legislación estatal como la autonómica a las mismas.
Este análisis viene marcado por la excesiva rigurosidad y su consiguiente tratamiento legislativo
para flexibilizar sus determinaciones con el fin de ajustarlo a la realidad.
