La violencia de género y transexualidad en el derecho penal.

Abstract

In the following paper, we will analyse the legal actions taken by the criminal code with regards to the gender violence women suffer. We will also answer whether transgender women fall under the protection of the Integral Measures of Protection against gender violence law, part of the LO 1/2004 of the 28 of December. To clearly confront this issue, we will study the concepts of gender violence and transsexuality. This paper also includes other controversial and relevant concepts to further delve and understand this question. These definitions are: sexual orientation, gender identification, sex, gender, intersexuality, transvestism and homosexuality. Further on, we will analyse the International, European and National legislative framework with regards to gender violence and transsexuality. In the same way, we will delve into the Spanish Criminal Code and their stance towards gender violence starting back in 1822 from that moment to the present. Including the modifications made by the LO 1/2004 of the 28 of December, after which different penal types of gender violence were introduced, in which an affective relationship was a requirement. We will also study the LO 1/2015 of the 30 of March which marks the reform of the LO 10/1995 of the 23 of November. This reform gave more ample and extender answer towards the protection given by the Criminal Code Law with respect to gender violence, with the inclusion of the gender aggravation which belongs to the article 22.4° and other concepts like Stalking and Sexting. To finalize, we will study the response given by the Criminal Code in situations where the victim is transsexual and actively or passively being a subject of gender violence, also whether it is necessary or not to include the subjective element of the dominion of men over women, a study of gender aggravation, and lastly the most relevant types of gender violence.

En este trabajo, analizaremos la respuesta del Código penal frente a la violencia de género que sufren las mujeres. Igualmente, responderemos si las mujeres transexuales, quedarían bajo la protección de la LO 1/2004, de 28 de diciembre, de Medidas de Protección Integral contra la Violencia de Género. Para poder abordar esta cuestión, estudiaremos los conceptos de violencia de género y transexualidad. Asimismo, se incluye en este estudio, conceptos afines e igualmente controvertidos, como es el caso de: orientación sexual, identidad de género, sexo, género, intersexualidad, travestismo y homosexualidad. Con posterioridad, analizaremos el marco normativo de la violencia de género y la transexualidad en el Derecho internacional, europeo y nacional. Del mismo modo, esta investigación incluirá el análisis de la violencia de género en el Código Penal español, desde el año 1822 hasta la actualidad. Incluyendo la reforma del Código penal que se produce por la LO 1/2004, de 28 de diciembre, tras la cual se introducen tipos penales específicos de la violencia de género, siendo exigible una relación afectiva. Por otro lado, se abordará la LO 1/2015, del 30 de marzo, que provoca la reforma de la LO 10/1995, de 23 de noviembre, del Código penal, dando una respuesta más amplia a la protección que otorga el Derecho penal a la violencia de género, al incluir la agravante de género del art. 22.4ª CP, y, otros tipos penales, como el stalking y el sexting. Para finalizar, estudiaremos la respuesta del Derecho penal, en aquellos supuestos en los que el transexual sea sujeto activo o pasivo de las agresiones propias de la violencia de género, si es exigible el elemento subjetivo de dominio del hombre sobre la mujer, un estudio de la agravante de género, y, por último, lo tipos penales más destacables de la violencia de género
