El crimen de agresión. Especial consideración en el conflicto entre Rusia y Ucrania.

In the present work, we will focus on analyzing the crime of aggression and its conceptual
evolution in history, beginning with its first appearance in the Nuremberg (TMIN) and Tokyo
(TMIT) tribunals, going through its 1974 codification, to finally arrive at the activation of the
jurisdiction of the International Criminal Court over it and the main obstacles to its effective
prosecution.
Finally with the knowledge acquired from analyzing the crime of aggression. It is intended
to apply the criminalization of the act of aggression to the current conflict between Russia and
Ukraine, verifying the existence of war crimes, crimes against humanity and the crime of
aggression. En el presente trabajo nos centraremos en analizar el crimen de agresión y su evolución conceptual
en la historia, comenzando con su primera aparición en los tribunales de Nuremberg (TMIN) y
Tokio (TMIT), pasando por su codificación de 1974, para finalmente llegar al activación de la
jurisdicción de la Corte Penal Internacional sobre el mismo y los principales obstáculos para su
efectivo enjuiciamiento.
Finalmente con los conocimientos adquiridos al analizar el crimen de agresión. Se pretende aplicar
la criminalización del acto de agresión al actual conflicto entre Rusia y Ucrania, verificando la
existencia de crímenes de guerra, crímenes de lesa humanidad y el crimen de agresión
