La legítima defensa. Especial mención a la legítima defensa putativa.

2022Abstract
The aim of this study is to examine one of the causes of justification recognized in
article 20 of the Criminal Code, which regulates the causes for exemption from
criminal responsibility. It also analyses its treatments and application by the courts
and the way in which external and personal circumstances affect the application or
non-application of this figure. The cause of justification goes beyond what is
simply stated in the Criminal Code, so that the analysis carried out by the different
courts will not be enough with the simple application of art. 20, pp. 4 of the Penal
Code. In order to be able to apply the defence, it will also be necessary to take into
account limitations not established in the legislation, but which are recognized by
jurisprudence and a abroad sector of doctrine. The concurrence of the error in the
use of this figure will lead to the application of the same with some special
characteristics which are also emphasized in an attempt to gain a more in-depth
knowledge of the so-called: "putative self-defence" Este trabajo tiene como objetivo profundizar en una de las causas de justificación
reconocidas por el Código Penal en su artículo 20, en el se regulan las causas que
eximen de responsabilidad criminal. Analiza también su tratamiento y aplicación
por parte de los órganos jurisdiccionales y la manera en que afectan las
circunstancias externas y personales a la hora de la aplicación o inaplicación de
esta figura. La causa de justificación va más allá de lo simplemente recogido por el
Código Penal, de manera que el análisis llevado a cabo por los diferentes
tribunales no bastará con la simple aplicación del art. 20, apdo. 4 del Código
Penal. Para poder aplicar la eximente, será necesario también atender a unas
limitaciones no establecidas en la legislación pero que sí son reconocidas por la
jurisprudencia y un amplio sector de la doctrina. La concurrencia del error a la
hora de acogerse a esta figura dará lugar a la aplicación de la misma con unas
características especiales en las que también se incide, en la pretensión de conocer
más en profundidad la denominada: “legítima defensa putativa”.
