Las cláusulas de jurisdicción insertas en el conocimiento de embarque: oponibilidad frente a terceros.

Abstract

Los contratos de transporte marítimo en régimen de conocimiento de embarque frecuentemente incorporan cláusulas de jurisdicción o sumisión a determinados juzgados y tribunales. Cuando el conocimiento de embarque se transmite a un tercero que no fue parte en la formalización del contrato surge la cuestión problemática sobre si ese tercero debe quedar vinculado por dicha cláusula. Para llevar a cabo el análisis de la citada cuestión es necesario hacer un estudio de las normas, tanto a nivel Unión Europea, el Reglamento 1215/2015, como nacional, con la Ley de Navegación Marítima. Además, es imprescindible recurrir a la jurisprudencia sentada en la materia, ya que durante mucho tiempo fue la única vía de solución al problema planteado.

Contracts of carriage by sea under bill of lading frequently incorporate jurisdiction or submission clauses to certain courts and tribunals. When the bill of lading is transmitted to a third party who was not an original party to the contract, the problematic question arises as to whether this clause is enforceable against the third party. In order to carry out the analysis of the aforementioned problematic issue, it is necessary to make a study of the rules, both at European level, Regulation 1215/2015, and at national level, with the Maritime Navigation Act, in addition to resorting to the jurisprudence ruled on the matter.
