La ley 8/2021 por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica, y su repercusión en el ámbito notarial.

Abstract

Law 8/2021, of January 2nd, which reforms civil and procedural legislation to support people with disabilities in the exercise of their legal capacity, has finally arrived to complete the introduction of the Convention system of the United Nations of 2006 characterized by introducing "support measures" to ensure the exercise of the legal capacity of persons with disabilities. The accidental protagonists of the new system are, without a doubt, the legal operators who have been entrusted with its implementation and, among them, notaries stand out for being the most significant support in terms of configuring the will. With the help of this figure, they will lead their own decisions and will be able to carry out all legal business with the limitations that, advised at all times, they will determine on their own.

La Ley 8/2021, de 2 de enero, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica, por fin ha llegado para culminar la introducción del sistema de la Convención de Naciones Unidas del 2006 caracterizado por introducir “medidas de apoyo” para asegurar el ejercicio de la capacidad jurídica de las personas con discapacidad. Los protagonistas accidentales del nuevo sistema son, sin duda, los operadores jurídicos a los que se les ha encomendado su puesta en marcha y, entre ellos, destacan los notarios por ser el apoyo más significativo en términos de configurar la voluntad. Con la ayuda de esta figura, liderarán sus propias decisiones y podrán llevar a cabo todo negocio jurídico con las limitaciones que, asesorados en todo momento, ellos mismos dispondrán.
