Los delitos contra la seguridad e higiene en el trabajo: especial referencia a los sujetos.

The protection of safety and hygiene at work is configured as an obligation that the spanish
constitution imposes on public authorities, and also constitutes one of the guiding
principles of social and economic policy.
Criminal protection in this area is justified by the size of the assets affected and the
growing level of occupational accidents. Thus, the legislator has configured articles 316
and 317 of the Penal Code for this purpose.
With respect to identifying the protected legal interest in these crimes, there are different
doctrinal and jurisprudential opinions that will be analyzed. Also, the figure of the active
subject will be studied, with special reference to the delegation of functions. In addition,
the self-endangerment of the worker and its impact on the criminal liability of the employer
will be analyzed. La protección de la seguridad e higiene en el trabajo se configura como una obligación
que la CE impone a los poderes públicos, y además, constituye uno de los principios
rectores de la política social y económica.
La protección penal en este ámbito se justifica en la entidad de los bienes afectados y en
la creciente cota de siniestralidad laboral. Así, el legislador ha configurado para este fin
los artículos 316 y 317 del Código Penal.
Respecto a identificar el bien jurídico protegido en estos delitos existen diferentes
opiniones doctrinales y jurisprudenciales que serán analizadas. Igualmente será objeto de
estudio la figura del sujeto activo, con especial referencia a la delegación de funciones.
Asimismo, se analizará la autopuesta en peligro del trabajador y su incidencia en la
responsabilidad penal del empresario.
