After a marital breakdown, the controversial issue about the attribution of
the use of the family home must be resolved, which causes serious
conflicts in the field of family law.
On this matter, we will analyze, in the first place, the concept of family
home and the right of use over it, paying attention to the concept of
ownership of the family home. In addition, a study will be carried out with
the support of the jurisprudence on the cases in which there aren't children
as well as the cases in which different guardianship and custody regimes
appear when there are children when proceeding to the attribution of the
use of family home.
It is also intended to analyze the various problems arising from the
payment of the mortgage loan that taxes the family home in cases of
marital breakdown and the consequences arising from the non-payment of
these mortgage payments such as the assumption of foreclosure, in order
to study the several solutions and the various criteria to be applied in
specific cases to prevent damage to the occupants of the family home Tras una ruptura matrimonial, se debe resolver la cuestión controvertida
sobre la atribución del uso de la vivienda familiar que provoca graves
conflictos en el ámbito del derecho de familia.
Sobre este asunto analizaremos, en primer lugar, el concepto de vivienda
familiar y el derecho de uso sobre ella, prestando atención al concepto de
propiedad de la vivienda familiar. Además, se realizará un estudio con
apoyo en la jurisprudencia sobre los supuestos en los que no existen hijos,
así como de los supuestos en los que aparecen distintos regímenes de
guarda y custodia cuando existen hijos a la hora de proceder a la
atribución del uso de la vivienda familiar.
Se pretende, además, analizar los diversos problemas surgidos sobre el
pago del préstamo hipotecario que grava la vivienda familiar en los casos
de ruptura matrimonial y las consecuencias surgidas por el impago de esas
cuotas hipotecarias, como el supuesto de ejecución hipotecaria, con el
objeto de estudiar las diversas soluciones y los diversos criterios a aplicar
en los casos concretos para evitar que se produzcan perjuicios a los
ocupantes de la vivienda familiar
