Tratamiento penal del sexting terciario

Abstract

The advancement of technology has revolutionized our society, bringing very positive aspects. However, it has also betrayed new forms of crime by using ICT as a means. That is why the legislator has tried to typify new behaviors such as the one that will be the object of study in this work on the inconsistent dissemination of images obtained with consent and, especially, the serious consequences that are taking place in the field of minors. However, it is worth considering whether the person responsible for the behavior of sexting would only involve the person who directly obtains the images or videos of sexual content and subsequently disseminates them without the victim's authorization or whether third parties who distribute them to other people are punishable. We will therefore talk about tertiary sexting and its possible typification.

El avance de la tecnología ha revolucionado nuestra sociedad, aportando aspectos muy positivos. Sin embargo, es evidente que también ha traído consigo nuevas formas de delincuencia empleando como medio las TICs. Es por ello por lo que el legislador ha tenido que tipificar nuevas conductas como la que será objeto de estudio en este trabajo relativa a la difusión inconsentida de imágenes obtenidas con consentimiento y, especialmente, las graves consecuencias que esto conlleva en el ámbito de los menores de edad. No obstante, cabe plantearse si el responsable por la conducta del sexting implicaría solo a quien obtiene directamente las imágenes o vídeos de contenido sexual y posteriormente las difunde sin autorización de la víctima o si es punible a terceros ajenos que la distribuyen a otras personas. Hablaremos por tanto del sexting terciario y de su posible tipificación.
