Tutela judicial de los derechos fundamentales laborales.

Abstract

The presents paper carries out a study of the broad subject of judicial protection of fundamental labour rights, from a procedural point of view, which will allow us to synthesise the most outstanding peculiarities of this field. It provides a new analysis after the repeal of the Labour Procedure Act and the entry into force of the Law Regulating Social Jurisdiction. For a better understanding, the research starts with the systematisation that our Magna Carta makes of the fundamental rights in the field of Labour Law, in relation to the level of protection it grants them. The final degree project pass through a detailed analysis of the ordinary process, and specifically, of the special, preferential and summary process that aims to guarantee the constitutional mandate of celerity contained in article 53. The paper examines the effective judicial protection from a declaratory, executive and precautionary perspective, which as a whole will ensure that those affected by the infringement of their fundamental rights receive an effective response. All of this, it is analyzed under the focus of human dignity as an inspiring value of our legal system.

El presente trabajo realiza un estudio de la amplia materia de la tutela judicial de los derechos fundamentales del trabajo, desde un punto de vista procesal, que nos permitirá sintetizar las peculiaridades más destacadas de este ámbito. Aporta un nuevo análisis tras la derogación de la Ley de Procedimiento Laboral y la entrada en vigor de la Ley Reguladora de la Jurisdicción Social. Para una mejor comprensión, la investigación parte de la sistematización que nuestra Carta Magna hace de los derechos fundamentales en el ámbito del Derecho del Trabajo, en relación con el nivel de protección que les otorga. Pasando por el análisis pormenorizado del proceso ordinario y, en concreto, del proceso especial, preferente y sumario que pretende garantizar el mandato constitucional de celeridad contenido en el artículo 53. Examina la tutela judicial efectiva desde una perspectiva declarativa, ejecutiva y cautelar, que en su conjunto garantizará que los afectados por la vulneración de sus derechos fundamentales reciban una respuesta eficaz. Todo ello, se analiza bajo el enfoque de la dignidad humana como valor inspirador de nuestro ordenamiento jurídico.
