La prohibición de la tortura y la responsabilidad del estado por la comisión entre particulares

Abstract

This paper studies the prohibition of torture, making a special mention to the international responsibility states have for the perpetration of torture between individuals. First, it shows the origin of the prohibition of torture and its evolution in the society until its current situation of ius cogens and what this means. Next, it studies the main instruments of regulation of the prohibition. Starting with the regulation of United Nations through the Convention Against Torture. On one hand, it analyses the definition of torture and its elements: a qualified subject, intentionality and enough severity. On the other hand, it creates the Committee Against Torture and its functioning which consists on ensure the fulfillment of the Convention though four mechanisms. After the UN regulation, this paper studies the Regulation of the European Council, both on a general level (ECHR) and in a specific level with the Convention for the Prevention of Torture, highlighting the most important aspects of each. Finally, this paper raises the question of whether individuals can commit torture and, if so, what is the state responsibility using ETHR jurisprudence.

Este trabajo estudia la prohibición de la tortura, haciendo una especial mención a la responsabilidad internacional que tienen los Estados por la comisión de tortura entre particulares. En primer lugar, se muestra el origen de la prohibición de la tortura y su evolución dentro de la sociedad hasta llegar a su situación actual de norma ius cogens y lo que esto significa. Seguidamente, se estudian los principales instrumentos de regulación de la prohibición de la tortura. Empezando con la regulación de Naciones Unidas a través del Convención contra la Tortura. Por un lado, se analiza la definición de la tortura y los elementos que la componen: un sujeto cualificado, intencionalidad y actos de gravedad suficiente. Por otro lado, la creación del Comité contra la Tortura y su funcionamiento, el cual se basa en asegurar el cumplimiento del Convenio mediante cuatro mecanismos diferentes. Después de ver la regulación de Naciones Unidas, se pasa a estudiar la que hace el Consejo de Europa tanto a nivel general (CEDH) como específico con el Convenio de Prevención de la Tortura, destacando las cuestiones más importantes de cada una. Para finalizar, se plantea si los particulares pueden cometer tortura y, en su caso, la responsabilidad de los Estados haciendo uso de la jurisprudencia del TEDH.
