Fake news: ¿derechos fundamentales en conflicto?

Abstract

Fundamental Rights are located as the nerve center of Spanish constitutionalism, and due to the great importance they have in society, this project will analyze both their nature and the possible conflicts that may arise between them and which path is the one we need to follow to solve them. All this will be accompanied by an analysis of one of the great concerns worldwide: fake news. For this reason, it is vitally important to answer the following questions: What is fake news ? What relationship do they have and how do they affect fundamental rights? Is spreading fake news a criminal act? What measures have been taken to prevent them? Should social networks be controlled? In order to respond to all this, an exhaustive analysis of fake news has been carried out, with the consequent propositions of possible solutions. In any case, we must always keep in mind that the purpose of this final degree project is not only informative but also to raise awareness.

Los Derechos Fundamentales se sitúan como eje neurálgico del constitucionalismo español, y debido a la gran importancia que tienen en la sociedad, en este trabajo se analizará tanto su naturaleza como los posibles conflictos que pueden surgir entre ellos y que camino es el que se ha de seguir para poder resolverlos. Todo ello, estará acompañado de un análisis sobre una de las grandes preocupaciones a nivel mundial: las noticias falsas. Por eso, es de vital importancia resolver los siguientes interrogantes: ¿Qué son las “fakes news”? ¿Qué relación tienen y cómo afectan a los derechos fundamentales? ¿Difundir noticias falsas es un acto delictivo? ¿Qué medidas se han adoptado para prevenirlas? ¿Deben de controlarse las redes sociales? Para poder responder a todo ello, se ha hecho un análisis exhaustivo de las noticias falsas, con las consiguientes proposiciones de posibles soluciones. En cualquier caso, debemos de tener siempre presente que el fin de este trabajo de fin de grado no es únicamente divulgativo sino también concienciador.
