El delito de acoso persecutorio del art. 172 ter del Código Penal

Abstract

Through LO 1/2015, of March 30, which modifies the Penal Code, the crime of harassment or stalking is incorporated into art. 172 ter of our punitive text with the purpose of typifying those criminal behaviors that cannot be included in the criminal types of threats or coercion. In this sense, in order to be able to convict for a crime of harassment, it is necessary for the active subject to comment on some of the typical behaviors provided for in section 1º of the precept, and in addition, it is necessary that a series of requirements be met, that is, that the harassing acts are carried out insistently and repeatedly, without being legitimately authorized and that seriously alter the development of the daily life of the victim, directly causing a serious impairment in some of the aspects that make up the freedom to act of the passive subject. For this reason, making an initial approach to the historical-legislative background of this new criminal offense, as well as analyzing its typical structure, addressing the different doctrinal and jurisprudential criteria, will be the main purpose of this work.

Mediante la LO 1/2015, de 30 de marzo, por la que se modifica el Código Penal, se incorpora el delito de acoso o stalking en el art. 172 ter de nuestro texto punitivo con el propósito de tipificar aquellas conductas delictivas que no pueden encuadrarse en los tipos penales de amenazas o coacciones. En este sentido, para poder condenar por un delito de acoso es necesario que el sujeto activo comenta alguna de las conductas típicas previstas en el apartado 1º del precepto, y además, es necesario que se cumplan una serie de exigencias, es decir, que los actos acosadores se lleven a cabo de forma insistente y reiterada, sin estar legítimamente autorizado y que alteren gravemente el desarrollo de la vida cotidiana de la víctima, provocando directamente un grave menoscabo en alguno de los aspectos que integran la libertad de obrar del sujeto pasivo.
