El teletrabajo y la conciliación familiar

Abstract

This final degree Project shows a legal análisis of the certain sentences that were producen in Spain forma the emergence of teleworking as an alternativa to avoid paralyzing the economy at the time of covid 19. Teleworking has been a phenomenon that in Spain it had not fully settled down until the year 2020, when, due to the pandemic, we were foreced to adapt our lives to a situation of total isolation. It was then that problems began to arise regarding the need to have regulations appliciable to this modality and, in turn, to the different interpretations that the different courts made of it. In this work, some sentences of interest Will be analyed and, in turn, a critical relfection of them will be given, taking into account the scientific doctrine and the regulations applicable to each case.

Este trabajo de fin de grado muestra un análisis jurídico de las determinadas sentencias que se produjeron en España a partir del surgimiento del teletrabajo como una alternativa para no paralizar la economía en la época de la covid 19. El teletrabajo ha sido un fenómeno que en España no había llegado a asentarse totalmente hasta el año 2020, que, debido a la pandemia, nos vimos obligados a adaptar nuestras vidas a una situación de aislamiento total. Fue entonces cuando empezaron a surgir problemas en cuanto a la necesidad de tener una normativa aplicable a esta modalidad y, a su vez, a las diferentes interpretaciones que hacían los diversos tribunales de la misma. En este trabajo se irán analizando de forma individual algunas sentencias de interés y a su vez se dará una reflexión critica de las mismas teniendo en cuenta la doctrina científica y la normativa aplicable a cada caso.
