La patria potestad y la libertad religiosa del menor

Abstract

In this work we want to highlight the legislative instruments that we have for the protection of the to religious freedom of minors and the limits of parents regarding their right/freedom of parental authority. We will highlight the rights and duties of parents in relation to their children and will try to give content to various concepts related to our topic. We will learn about the conflicts that may arise during marital crises between parents and children and how they have developed in accordance with jurisprudence, always taking into account the best interests od the minor, specifically in the care that the State must provide to children to guarantee their development. Personal this means that all decisions made must be oriented towards the wellbeing and full exercise of the rights of minors.

En este trabajo queremos resaltar los instrumentos legislativos que tenemos para la protección del derecho de libertad religiosa de los menores y los límites de los padres en cuanto a su derecho/libertad de la patria potestad. Resaltaremos los derechos y deberes de los padres en relación con sus hijos e intentaremos dar contenido a varios conceptos relacionados con nuestro tema. Conoceremos los conflictos que puedan surgir durante las crisis matrimoniales entre padres e hijos y como se han desarrollado en atención a la jurisprudencia atendiendo siempre en favor del interés superior del menor, concretamente en la atención que el Estado proporciona a la infancia para garantizar su desarrollo personal, esto quiere decir que todas las decisiones que se tomen deben orientarse al bienestar y pleno ejercicio de los derechos de los menores.
