Defensa y protección de los valores de la Unión Europea: el mecanismo del artículo 7 del TUE.

Since its inception, the European Union has sought to create, maintain and promote
common objectives as an international organization. One of its primary objectives is
to protect and promote the fundamental values of Article 2 TEU, which are: respect
for human dignity, freedom, democracy, equality, the rule of law and respect for
human rights, including the rights of persons belonging to minorities. In order to
protect these values, the TEU grants the Union a sanctioning mechanism in Article 7,
which was activated for Poland and Hungary years ago, but which has proved to
possess insufficiencies for the current reality in the EU. The purpose of this paper is
to study the mechanism for the protection of the fundamental values of the EU, from
its evolution as a norm to the analysis of its limitations, taking as an example its
current materialization in the cases of Poland and Hungary. La Unión Europea (UE) ha velado desde su inicio por crear, mantener y fomentar
unos objetivos comunes como organización internacional. Uno de sus objetivos
primordiales es proteger y promover los valores fundamentales del artículo 2 TUE,
que son: el respeto de la dignidad humana, libertad, democracia, la igualdad, el Estado
de Derecho y el respeto de los derechos humanos, incluidos los derechos de las
personas pertenecientes a minorías. Con el fin de proteger estos valores, el TUE otorga
a la Unión un mecanismo sancionador en el artículo 7, que se activó para Polonia y
Hungría hace años, pero que ha resultado poseer insuficiencias para la realidad actual
en la UE. El presente trabajo tiene como objeto el estudio del mecanismo protector de
los valores fundamentales de la UE, desde su evolución como norma, hasta el análisis
de sus limitaciones tomando como ejemplo su actual materialización en los casos de
Polonia y Hungría
