AB The relevance that cybercrime has acquired today, legislation that leaves gaps inpunishability, the difficulty to determine the authorship and the place of commission ofthe crime and the emergence of a new resource such as cloud computing, have led toour realization the next question:Is it possible to consider the cloud computing as a material object of the crime of art.197 of the Spanish Penal Code?This question has been the "x" that we have tried to clear in the present work. For thiswe have analyzed and studied the wording of art. 197 of the CP, based on previousstudies referring to or linked to the seizure of traditional sources of intimateinformation. Examining whether it is possible to understand the "cloud" as a document(material object of the crime of Article 197 CP), for which, in turn, we have startedfrom the concept provided by the CP in its art. 26.
