AB The importance that our Legal Order attaches to the rights of citizens is questioned bythe figure of the employment contract, where the citizen, now turned into a worker,agrees to submit to the power of organization and direction of another person inexchange for a compensation, which constitutes the means through which he obtainshis livelihood, quality of life and personal fulfillment. The problem arises when thatacceptance of submission involves situations that restrict rights, especially when wetalk about the so-called Fundamental Rights, to which our Constitution grantsmaximum prevalence and protection. This work aims to analyze a common space, byconsensus, in which the entrepreneur is allowed to exercise his power of managementwithout impeding with fundamental rights, while studying the special process beforethe Social Jurisdiction. When those fundamental rights have been violated, their specialrules and guarantees, since a citizen, although he has acquired the status of worker byvirtue of the acceptance of the contract, will never lose his natural and basic status as acitizen.
