AB The filiation is the relationship or bonds that unites a person with both of his or herparents or with just one parents. It is biological fact with legal significance, so that it canbe said that the legal relationship of filiation will be established between those personsto whom the Law attributes the status of father or mother, and those to whom it attributesthe status of child. The determination of the filiation derived from assisted humanreproduction techniques es regulated in the LTRHA, regulation that responds to somespecific rules that are based on different principles than those that inspire the regime ofthe Civil Code, leaving clear two tendencies,, while the LTRHA give greater relevanceto the parent´s will, the Cc prioritizes the principle of biological truth. All this, withoutprejudice to the LTRHA refer to the Civil Code to respond to the possible legal gaps. Theobjective of this work is the analysis of the determination of the filiation derived fromassisted reproduction techniques from both the extrajudicial and judicial point of view.
