AB Joint custody is an innovative new institution which seeks to help children in their developmentthrough their childhood years. If enforced in the correct way, this will greater benefit the child toenable them to interact freely with both progenitors.It is of Paramount as divorce´s are forever on the rise in today´s society, resulting in one parentbeing absent from the child´s childhood years, leadind to fewer visits, and less contact with theminor. The process in awarding joint custody can become simple to both parents and their child.This paper analysis´s the different ponit of views that involves joint custody; the obligations laiddown the exercising of joint custody for the guardians, the different standars applied by the tribunalto grant the joint custody, and the jurisprudential side and how this concept has evolved.
