AB The objective of this work is to give visibility to the elderly in thefield of Criminal Law, since the current regulation does not foresee aspecific treatment taking into account age since this is not included as adiscriminatory circumstance in article 22.4 of the Criminal Code and norin the special part of the Penal Code since it is not included as a taxableperson in the different criminal figures.Specifically, in this work we will make a proposal for a unitarydefinition of the elderly person, and we will address the study of thecriminal protection of the elderly in the system of generic circumstancesand also in the different criminal figures of the special part. Finally, aftermaking a doctrinal and jurisprudential analysis of the subject, we willpropose some lege ferenda proposals aimed at granting adequate andnecessary protection to the elderly.
