AB The maintenance obligation are regulated in the Civil Code between thearticles 142 and 153 and this regulation allows those who appear asobligated to ask for a family maintenance because they can´t survivewithout aid from their family. This obligation consists of a compensationwhich content is an amount of money determined by the judge and thiscompensation is based on 3 charasteristics: the family link, the needs ofthose who asks for the maintenance and the economy of the obligated. Theobligation is composed of two person the who ask for the alimentary aidand the one who has to satisfy the compensation is the obligated. In theCivil Code includes those who are obligated and the order in where theywould have to fulfil the obligation. The spouse first, then the ascending anddescending family and in last place the siblings. Also in the Civil Codeappears how the obligation can be extinguished depending on any changesin the characteristic and economy of any member who were part of theobligation or the death of those members.
