AB The figure of the private detective is configured as a useful instrument forobtaining evidence. Our legal system attributes a series of functions to it,which delimit their scope of action, always in accordance with the legal limitsimposed on it.Fundamental rights constitute one of the limits to research activity. The rightto privacy of art. 18 of the Spanish Constitution grants protection to theprivate sphere of all people against outside interference.However, the private detective, in the performance of his professionalactivity, may carry out unlawful interference in the private sphere of theinvestigated person.Through jurisprudential analysis, it is possible to know the position of thedoctrine in the face of conflicts derived from interference in the right toprivacy as a result of the investigation of the detectives.
