AB The minor contract supposes a contractual figure, which serves to satisfyneeds, which ordinary contracting procedures do not satisfy. However, itsabusive use, the corrupt actions of allocation of public funds, and themalpractice on the part of certain contracting sectors, have caused extensiveregulation, but above all changing, to try to alleviate the continuousproblems of legality and legislation, which caused the use of this type ofcontract.Law 9/2017, of November 8, on Public Sector Contracts, which transposesinto the Spanish legal system the Directives of the European Parliament andof the Council 2014/23/EU and 2014/24/EU, of February 26 2014, was aturning point where an attempt is made to alleviate all the problems causedby the minor contract in previous regulations. However, the articulation ofthis law has also led to major legislative deficiencies, which have led tolines of understanding by different Public Contracting Advisory Boards, orORIESCON, to mark lines of understanding, on the applicability of theminor contract. .The reform of this law, carried out by Royal Decree-Law 3/2020 ofFebruary 4, of urgent measures by which various European Uniondirectives in the field of public procurement in certain sectors areincorporated into the Spanish legal system, It will tell us over time, if themodifications introduced are sufficient to solve all the confusing andinefficient issues, in relation to the minor contract.
