AB Article 138.1 of the Penal Code states that: "whoever kills another will be punished, asa criminal of homicide, with a prison sentence of ten to fifteen years." In the presentwork, the active subject and his personal circumstances are analyzed through the studyof the work of psychologists and specialists in the field to know the personality andbehavior of the murderer. The functioning of the Penitentiary System and its efforts tocomply with the constitutional purposes of the sentence and to be able to offer a secondchance to the convicted are broken down. Despite the correct functioning of this andafter the detailed analysis of all this, a way of acting and influencing the earlypersonality of the potential murderer is proposed to prevent his behavior frommanifesting itself and thus avoid the emergence of a victim and having to put The entiremechanism provided for by the Legal System for the prosecution of the crime is inplace.
